I have a masters and was under the impression that my PERM application will be filed under the EB2 category.
My employer just informed me after 2 years that the minimum qualifications for my job state an equivalent years of experience which prevents my application from being filed under EB2.
I want to understand the implications of letting them file my application under EB3.
- If I get my I-140 under EB3 and change employers who then file it under EB2, does my I-140 and priority date still remain the same?
- Is it better to get the filing process started under EB3 or is it better to change employers and file it in EB2?
- Any other pros and cons of my situation?
