    Hi there,

    My company sent a Prevailing wage determination request (PWD) and the number that came back from the DOL is about 15% more than what I'm being paid. I think that number doesn't make a whole lot of sense given my salary is very fair and I know American friends at other companies who make less than I do. Has anyone been in this situation and what did you and your employer do?

    Sorry, I really donot know the answer to your question. If you don't mind, can you tell me how long it took for you to get the prevailing wages from DOL after filing. Because my attorney has been telling me that he has not recieved it yet for the past 3 months. Appreciate your response.

        PW Wage and Unions

        You mentioned salary but If hourly then the employer is obligated to pay at the higher PW or you can take it up with DOL. Sometimes employers pay the extra pw rate through health and/or retirement benefits as well. Often PW rates are so high due to union dominance in your industry and area.

          The wage determination is based on the job requirement that was specified on the PERM. So, it can be more than what you currently get. It's quite normal. Your employer should pay that salary when you get green card.

            Just an idea - Either talk to your employer to pay you the 15% at the time of filing I-485 with current benefits OR pay you the 15% with taking away one week of vacation. Not sure about legality of this issue.

            It is recommended that you get paid at least the prevailing wage at the time of filing I-485.
