Perm process
I work for a mutli-national company on H1B visa and last year they began my Perm process. But recently they informed me that during the recruitment process they have found eligible candidates and they cannot move on with the labour certification. HR is now asking me to join another position within the same company which is 50% different from what I am doing right now so that they can re-apply for my PERM. They have said that they would apply only in EB3 category even though I have a masters degree. Meanwhile, another company is offering me a position similar to what I am currently doing right now and have agreed to apply for my GC in EB2 category. My question is can the new company file my LC if my job is not 50% different? Does my previous PERM process initiated by my current employer have any effect on the new PERM process that this new employer will initiate if I decide to join them.
