I am on H1B visa working fulltime with a midsize company (100 employes). Company filed for my PERM with PD 25th Aug 2011. We received audit in Dec, replied immediately, received notice to conduct SR in March, replied immediately. After 6 months, DOL approved Ad response on 21st Aug 2012 and asked us to market the ad. My attorney said that as DOL took time and whole process will take more than ayear so we can extend for 7th year of H1 (my 6th year expires in Sept 2013).
If DOL denies the PERM after say 3 months from now then also are we eligible to extend H1 for 7th year ?
