    Hi,

    I am an Indian citizen residing in USA on H1-B Valid till July 2014(from current employer) but stamp on my passport from Previous employer has already expired. I have a business trip to Germany coming up in Feb 2014. Does anyone have a solution to get a Schengen Visa in this situation. Also, I will be returning to USA after my business stay (of 5 days) in Germany. Any help is deeply appreciated.

      Along the lines of this topic, my current H1B in my passport has expired, though I have a valid I-797B extension currently. I am going back to India to get the H1B visa stamp. I applied for a Schengen visa today (stopover on my way from US to India) and they initially told me I could not apply for the Schengen visa as I did not have an up to date H1B stamp. When I explained to them I was going back to get the stamp, they initially gave me push-back, but later took my passport, application and money. I had my valid I-797 and all the other required documents, that I submitted to them. When I asked if the visa is approved, they said I would find out in one week- but did not give a clear answer.

      Has anyone on an H1B ever been in this situation? It seems like some people on this board have dealt with this situation.

      Your opinion/experience will be helpful.

          Did you guys get your visa? I have an expired H1B stamp, valid extension paperwork. I want to stop by Europe for a week on the way to India to get my visa stamp.

            Hi,

            Yes, we got our Schengen Visas at the German Consulate. Switzerland Consulate was ready to give us the visas as well. But the Belgium Consulate refused to issue a visa without a valid US visa. So you might want to double check with the particular Consulate. Along with all the listed documents we were asked to provide the copies of our expired visas, I-797 extension and a confirmation of an appointment with the US Embassy in Moscow (as a proof that we are going to obtain the new US Visa stamps)
