Schengen Short Stay Visa with expired H1B

My H1B visa stamp has expired, but I have a valid I797. I am flying to India, via France, which will require a transit visa. In India, I will be getting my H1 visa stamped. On my return trip, I will be stopping at France and Spain for a week before heading back to the US.

My question is: Will an appointment letter at the US Consulate in India suffice as proof of valid status on return for me to get a short stay Schengen instead of just a transit visa?
