  • Expired long stay German visa, what to do

    So in the case that someone had a Youth Mobility visa valid in Germany for the last four months that expired on August 25th 2012 (the original date of the departure flight) but had to change that departure flight for personal reasons to September 8th 2012 (about 2 weeks later) . What would that person need to do to leave the country and go back home (to Canada) without being fined, labelled as an Illegal immigrant or whatever else they might do to that person upon trying to fly home. Would it help to fly our of a different country? Is there a chance that they simply don't care that I overstayed an extra two weeks? I'm not entirely sure how to solve this problem

    whenever you leave the schengen area you have to go through immigration/exit procedure. it does not matter what country you leave from. if they notice your overstay you will probably be fined (but it's not a large amount). more problems might arise if you wish to return to the schengen area.

      Well, in 2006, my Dutch student residence permit expired about a month before I was to leave. I was told that there was a grace period, though. I'd say two weeks is ok. You can try to go to your Auslaenderbehoerde and see if they'll give you a Fiktionsbescheinigung to let you stay for another two weeks.

      This might all be moot, though, because you're Canadian, and don't need a visa to VISIT the Schengen area. The visa you have is a national visa. Once it expires, you can be a visitor in the Schengen area for 90 days. So, you will not be overstaying. I'm not sure how border guards deal with this, though.

      Still, to be safe try the Fiktionsbescheinigung.
