I'm trying to figure out if we can recapture the recapture period.
Meaning If my original H1-B 6 years complete on 12/31/15 and I have 180 days of recapture. This makes my H1-B max out date as 06/30/16 (approx). If I travel outside of US between 12/31/15 and 06/30/16...

I need some help/advice and I would really appreciate if someone can help me. This is regarding labor application ETA-9089 for green card not being filed before 365 days of my H-1B expiration date.

L1 B 5 yrs completed;H4 b4 365d outside US & then to H1B after 365d - H1 B duration?
I completed 5 years of L1B on March 31st, 2013.
I then decided to spend 1year/365 days outside the US so that I can apply for a fresh H1-B and get 3 years of work visa.
Now my question is :
Can I apply for an H4 visa now (Jan 2014) i.e. before completion...
