I had my consulate interview on 29th December for H1 at Mumbai and my case was approved and I was told to pick up my passport in 5-7 business days. Today is the 10th of January and my case still says 'under admin processing' on the CEAC website and the last updated date was 29th December... -
H1 approved in 2012 but expired, can I file under cap exempt
Hi everyone
My H1 got approved and stamped in 2012 But I never travelled to USA on H1.Can I now apply under cap exempt, if so what will be the validity, will it be six years from now I.e. 2021 or only the remainder three years I can use till 2018, if I apply this year in 2015.

We had our H1 approved with Visa issue date of 28Dec2012 and expiry date was 1 Dec 2014. We didnt join that company traveled (though earlier we have been there with the same company on L1 visa for roughly 3years), for some personal family reasons we had to stay back in India.
