Out of Status - Filing of H1 extension missed by oversight

Hello Friends,

My wife’s employer missed filing for her H1 extension and her H1 validity was until 8/26/2021 (she does have her i140 approved), its almost 30 days now since she will be out of status.
I wanted to check, if moving her to my H4 & then EAD is a better option compared...

My last day of working with my company was Aug 31 2017 after which I was terminated. My H1B visa is currently not held by any employer. My H1B visa is valid till May 2019. I had a discussion with a lawyer who told me that I can stay for 180 days from the last date of employment....
