Not sure if I-539 was filed, but I-129 is approved
I do not know if I-539 was filed by my attorney, but my H1B (second term) is already approved. RFE for stamping is asking for approved I-539 (from first term onwards). What can I do? My employer says I797 approval for I-129 that they filed is fine. But I dont want to take any chance. -

I came to US on H4 and then got my H1 approved and worked for an year on my H1 and then changed my status to H4.
I filed I-539 for change of status from H1 to H4 and it got approved. So I've my I-797 notice of approval for my H4
