Applying H4 when H1 is less than 4 months

I'm in H1b and its is my first entry, its been 8 months since i came to US and the visa has been given for 2 years, my
visa is expiring on September 2013, I was thinking to apply for my wife dependent visa(H4) by may 2013, will it be a problem getting the dependent visa as my visa...

Here are my L1A details :
Visa Expiry : Jul 2013
I-94 Expiry :Sep 2013

I plan to travel next week(Feb 13th/14th) to India for personal emergency & be back in a week.
