apply for passport reissue with i94

I am planning to apply re-issue of passport through BLS.

one of document proof they are asking is, "Notarized color photocopy of current valid US visa on passport or Green card or Employment Authorization Card or I-797 approval notice documents."

I don't have valid...

I'm currently in US and planning to send my passport to Indian Embassy in Chicago to change the last name. I believe they will issue a new passport and attach the old passport to it as the visa in on old passport. My question here is if we need to take out the I94 from old passport before submitting...
