I had an unused H1B stamped(Oct/1/2007 through Sep/14/2010) & filed by my previous employer but expired in the year 2010. I never traveled on it. Currently I moved to another employer in offshore, and I would like to know, weather I am cap exempt or not;

Can I claim the unused duration on my L1A visa
I have an L1A visa and extended twice so far.3+2+2. But in my initial 3 years period, I was not in USA for 18 months. Once I complete the 7 Years period, can I reclaim this unused 18 months period? -

My H1B is approved this year and is valid till sep 2014. I am on L1A right now and my wife on L2 EAD working . We both are working for same employer.
I cant change to H1 this year as my wife has to move to H4 and will lose her job. I am trying to apply H1 for her in 2014.... -

This could be repeated however I am not aware of latest facts and news so I am asking this again.
I had my H1B Visa approved on oct 2007 which Expired in Sept 2010.
But I didnt go to USA ever meaning completely unused H1B at expiration.
