Am I H1b quota exempt? Currently on H4 with an approved H1b petition

My employer filed for my H1b when I was on my OPT and it got approved. According to the petition, it was valid from Oct 1, 2012 to Sept 30, 2013. After my petition got approved I did not take any action from my end (like applying for COS or stamping etc) and I left for India on Dec 21, 2012 to work...

I am on L1 from 2012 and I have an unused H1B petition approved in 2006. I would like to transfer from L1 to H1B.
Can I use my unused H1B petition approved in 2006 to apply H1B in CAP exempt?
