  • what is section 216 notice?

i got my second int. this sept. 22th 2012. io was pretty ok with us she separated us couple times and she didn't really do like a cross-questioning. Every single time she sent me outside io was asking my wife are you sure about him ? He is white you are black he is from this country your are american etc. at the end of the interview she made both of us sign the section 216 notice and io "said we are done!" when i asked io if you dont mind me asking whats is your decision or did you make a decision io said ask your wife she knows the answer. Io asked my wife if you really trust your husband if you really feel that he deserves his gc ill approve you but if you say no im not sure i will re schedule you for a new interview in 30 days and my wife said yes trust him and he deserves his gc. that was her answer. So am i approved or not ? Did anyone have the same experience ? Signing that section 216 notice is a good sign or what ? its been almost 2 weeks i know its kinda early to expect the gc. but im nervous can someone help me ?

section 216 notice states that you have been approved and that explains the things to do about filling I-751 to remove conditional status in a couple of years.
You should get your reply within 60 days, if not Open Service request by calling customer service or go by info pass.

Do not fear. Conditional LPR status is given to spouses of US Citizens that have been married less than two years prior to filing for Adjustment of Status.

Practically speaking this means that the Conditional LPR will need to file to have the conditions removed 90 days prior to the two year anniversary of your Conditional Approval. This is simply another administrative check that your marriage is indeed a bona fide marriage and not a sham. Basically your filing your I-130 again, but this time its a new form I-751 and there is usually no interview with USCIS.

The description of section 216 Law:
When alien acquires status of conditional permanent resident. At the time an alien acquires conditional permanent residence through admission to the United States with an immigrant visa or adjustment of status under section 245 of the Act, the Service shall notify the alien of the conditional basis of the alien's status, of the requirement that the alien apply for removal of the conditions within the ninety days immediately preceding the second anniversary of the alien's having been granted such status, and that failure to apply for removal of the conditions will result in automatic termination of the alien's lawful status in the United States.
