  • Employment Based AOS Interview

    Hi All,

    My Employment Based AOS Interview is scheduled now, along with my family.

    Could someone share their experience of attending such interviews. I am working to bring my attorney to the interview, also.

    Any specifics that I need to be aware of ? Do I need to fully understand the details that are there in my I495 and I140 documents given. What about PERM ? Since I140 is with my employer, do I need to get that ?

    Should I also go through all of my previous H1's.

    For marriage specific documentation, would just having the Marriage Certificate issued in India and written in English, Lease Agreement and US Tax Returns documents suffice ?

    "USCIS has said the purpose of the interview is to detect fraud and increase security. USCIS will review your answers to the questions on the I-485 application and will also review evidence submitted with the approved I-140 immigrant petition. USCIS does not intend to re-open approved I-140s. However, USCIS will discuss the applicant?s prior education and/or experience if the credibility of the information is in doubt. USCIS also reserves the right to question the relationship between the principal applicant and any dependents to ensure the relationships are genuine"

    Everyone in the forum reports it's a painless interview. 15 minutes. Done. I think that paragraph sums it up nicely. They are not calling you in to re-open approved I-140s, and won't dive into details, unless credibility of the information is in doubt.

      I suggest to get a J supplement with yourself, since IO may ask.

      I have heard that it is a simple interview, but dont have a personal experience.

          With God's grace, the Interview went well. Out attorneys also came with us.
          We were asked questions just on the I485 and post that, we were asked to sign on the last page of the respective 485's. The one for my daughter - they didnt ask to sign.
          The officer then said that they had to review the CoB and CoC thing here. So my CoB is UAE while my CoC is India, and there was a confusion if the I485 dates are based on which. They said that they would call up and let the attorney know about next steps. Later in the day, they did call my attorney and said that he realized that the 485 is based on CoB and so my case should be good and he will give it for approval. He will also require another supervisor to have a look at it and would get approved the next day.
          Its been 5 days now. My attorney did say that they did not get back any further calls from the Officer, which means that things are going fine and my case would get approved soon, so hold tight.
          I am praying and hoping that things turn out well.
