Completed 5 years on L1B but both visa and i94 are still valid

  • Completed 5 years on L1B but both visa and i94 are still valid

    Hi,

    I have a question on regarding my stay on L1B visa for which i am not able to get a clear answer.
    I will be completing 5 years on L1B in October 2018 but my visa and i94 are good till March 2019. So my question is, can i stay in US till March 2019 or i have to go back in October 2018?
    I am getting mixed replies on this and hoping that someone can help me out here.

    You can claim days you did not work & got paid, like vacations & visit to home country. That way you can extend your stay by couple of week/months.

    Since you've your visa/petition/I94 valid till March 2019 - staying in USA should not be a problem.

    If you've plan to come back to USA, then better to go back before Oct 2018 & re-apply for a new visa.

      Thanks for the reply Libra_14. I have already claimed the days i was out and after that only, i will be completing 5 years in October. My question is once i complete 5 years, is it required to go back or can i still stay until Mar 2019 since my i94 and visa is still valid till that time.

        As I said before, since your I94 & petition is still valid, you are legally not overstaying.

        But, if you are willing to come back in future also, better to return to your home country as soon as you complete 5 years & apply for a new visa ( so that you won't have any issue for the new visa).
