    Hi,

    I need guidance on applying L1 and L2 extension

    Below is my scenario

    My I-94 is expiring on 4th Dec 2018 and I need to apply for extension before it expires

    I got married recently in August'18 .My spouse got her visa on 7th Sep'18 and will be travelling to US in mid of October'18

    Below are my queries regarding applying for extension

    1) Can I go ahead and apply for L1 extension while my spouse is still in India. Does it effect her travel plan in October

    2) My spouse will be visiting US for short span of 2 to 3 months (October to December) as she need to go back to India to complete her studies.

    3) When should I apply for my spouse L2 I-94 extension as she is yet to travel to US to get her I-94.

    4) Is it safe for my spouse to travel back to India while extension is in progress?

    5) Is it good to go ahead and apply for my L1 extension ?


    Please let me know the best options.

    Please contact a immigration attorney and apply for extension for both L1 & L2 through premium processing category.

        You can go ahead and apply for L1 extension. I had a similar situation. I had my I94 extension filed when I initiated my wife's visa. This should not affect your spouse travel since she has a valid visa.
        2) My spouse will be visiting US for short span of 2 to 3 months (October to December) as she need to go back to India to complete her studies.

        3) When should I apply for my spouse L2 I-94 extension as she is yet to travel to US to get her I-94.
        You can process your wife's I94 extension only after she enters US. You can start processing her I94 once she lands in US.
        4) Is it safe for my spouse to travel back to India while extension is in progress?
        It is not recommended to travel back while your extension is in progress. Other option would be, once you have your extension approved and receive new documents, you can process new visa for your spouse based on the extended petition.
        5) Is it good to go ahead and apply for my L1 extension ?
        Yes. You can go ahead and apply for extension. Apply for extension asap since you have less than 3 months for expiry.
