  • L2 to L1 Transfer

    If a person has L2 visa valid till Nov'12 and currently working for a company. Now if the comany files for a new L1 Visa so that the person can continue working, for L2 to L1 transfer, does the person needs to go back to the home country to get the L1 Visa stamped?

    Technically it is possible if the person and his/her employer meet the requirements for an L-1B and their company is willing to file the petition.The employee will have to prove his/hers one-year employment with the international organization (abroad) again to show that they are in fact, still eligible despite having switched over to L-2 for a period of time. If L2 to L1 is applied as COS and it comes in a with a new I-94 the employee need not go out of US for fresh L1 Stamping. Of course, after Nov 2012 if the employee leaves US for whatever reason they have to get L1 stamped in passport for their return. This is my opinion, but such conversion doesn't happen very often hence recommended to talk to an attorney who has done so successfully in the past.
