  • How will these situation pass interview?

    1) The groom had a previous marriage (also fraud) in the other country in 1992; he filed a US green card for his **** wife but divorced and dropped it in 1995. In 2007 he committed another fraud marriage but he did not list the fist one in both marriage certificate and in the USCIS application set.

    2) They never lived together yet using a physical address for their file
    They have a lawyer

    3) The work permit was returned by someone else and with a letter stated that the couple never lived at the address filed in their file (where the work permit was sent to) and stated their marriage was a fraud one.

    4) Telephone report of this fraud marriage was made months before the interview date

    What is the chance this couple will pass the interview for their temporary green card?

    Is this a case study or a real thing?

    1. Why is the first marriage a fraud marriage? I did not understand why you termed that marriage fraud?

    2. Probably will get caught during the interview.

    3. USCIS might have just marked the mail as returned undeliverable and may not have saved the letter. How is the person living at the address listed related anyway to the case. Some person on the street cannot write a letter to USCIS saying that the marriage is fraudulent and hope it will negatively impact the case.

    4. Probably will get noted in the file and the officers taking the interview may have special instructions to dig into the authenticity.


    The answer is it depends on how the interviewer deals with the case. But any fraud if uncovered at a later date can also result in revoking the green card even if they get it.

      This is the real case in life.
      The first marriage was fraud because he and his family said so.
      The person who reported about his use of **** address is the owner of the house and who has the case numbers when doing the report when returning the work permit card and submitted the immigration letter from the first marriage.
      Furthermore the couple never lived together because this marriage was a set up from a cult organization. He filed the divorce and requested a stop of the green card application because his family's pressure for the fear that if he fails the interview, his own U.S. citizenship may be revolked too.

        Don't want you to assume that I am taking sides here. Let us say for the sake of argument they say it is a **** marriage just to get you all worked up. No point in saying it is **** as the marriage lasted for 3 years. If the person took any $$ from the ex-wife with the promise of getting a GC, then it can be considered **** or sham marriage.

        I think immigration mail is to be opened by the addressee only and the owner of the house could be in a problem as he is just supposed to mark it return to sender, not open it, look at the contents and return it.

        USCIS officers are strict about material misrepresentation and if they get caught, it is the end of the story.
