  • What if Not Selected in H1B-2009 Lottery

    Hi All,

    I have been following up on the USCIS website. They have given dates by which those selected and are on waiting list can expect the hearing on their applications. Tentatively this will be known by June 2nd and another 15days for those on wait list.
    My question is those who are not selected (in 65K+2K) will be getting the Visa fees back with appropiate notice saying that they are not selected. However there is no dates provided by USCIS by which they will intimate who are not selected.
    If we know if by that deadline one does not gets any rejection notice then safely it can be assumed that one is either selected in 65K or 2K.

    Does anyone here knows the deadline for getting the rejection notice for not getting selected in lottery????

    Deadline ???

    WEll, its a question which everyone is thinking about. I lodged my case in USA thru an attorney there . Even they have no clue on the deadline or tentative date by which the unsuccesful applicants (in lottery) will be informed.
    I guess, the unsuccesful applicants (in lottery) will receive their application along with the fees as early as possible.

      Use principle of exclusion. If you don't get a receipt by June 2nd, you probably were not selected.

        Thats true... but for people who applied for Premium processing, and not yet received the receipt can believe that they are out.

          There are three possible things to consider:

          All selected PP applicants should receive a receipt/approval/RFE (all meaning you were selected in Lottery) by Today (4/29/08) since today is the 15th day. I assume USCIS, like everyone, loves money.

          All selected Regular applicants should receive a receipt/approval/RFE by 6/2/08.

          Then there is the waitlisted people and rejected people. I read that USCIS has said that they need 4 weeks to notify the waitlisted folks (probably a receipt mentioning the same) AND not selected folks (return the packet). This should mean that by 6/28/08 (although the source says 7/28/08), everyone not selected should know where they stand. Those waitlisted should hope for a positive outcome after this date until they get the final verdict.

          Oh law has it.

            H1B Visa 2009 lottery success

            Friends, I have got the file number yesterday for further processing of H1B visa 2009. Can anyone suggest the procedure from now onwards?

              Just a regular aPPLICANT FOR h1b 2009

              Okay, I wish to add here that , I am a regular applicant, no PREMIUM GUY. I have recieved the receipt from them.
              Another way to find out is that,,,CONTACT your employer who would know incase if the Cheque Amount has been debited from their Bank account.
              Incase YES,, Its a good news -otherwise, WELL FOUGHT, BETTER TRY NEXT time BUDDY!!!!

                If you got the receipt number from employer, you can check the status of your case on uscis.gov under Check Case Status. If your case got picked up for adjudication, the status check page will update and say if your case has been approved or pending.

                The next step depends on a few things such as whether a COS was requested or not.

                  Receipt Notice

                  Hi all,

                  I apply for Premium Processing and I have a masters degree in US and my lawyer did not get any receipt notice yet. What does that mean?

                    You know the answer. Wait till June 2nd to confirm it and affirm it. You might have OPT and a STEM degree. Use it.

                      I have my OPT and it's expiration date is May 14 2008. I got an Industrial Engineering degree from Turkey and I have a masters of International MBA in USA.
                      I am working as a programmer.
                      Do you think that I can apply for extension of OPT?

                        I want to say NO because your OPT is based on your Internation Business degree which does not fall in the STEM category.

                          Please help clear the confusion...

                          Hi,
                          I applied for H1B under the premium processing. And still haven't received any reply regarding my petition. I was under the impression that for premium processing USCIS would for sure intimate by 04/29/08. I spoke to the people who had filed my application. I was told that there are lot many people whose application was filed under PP and their status is still not known. My questions are:

                          1. If a person who applied under premium processing and has not received any status; should he/she assume that he/she has not been selected or

                          2. He/she might have been selected but USCIS is taking their time considering the number of applications or.

                          3. The person has been waitlisted and awaiting response.

                          4. What all possibilities are there.

                          Please help in clarifying this.

                            obvioulsy. premium processing is applicable only if ur case is picked up in lottery. if it is not picked up, it could be either rejected and sent back or be placed in waiting list. your 1000$ for PP will be refunded.

                            all wait listed and rejected petitions will be intimated after June 5(Oh law website).

                            4. What all possibilities are there.

                            either your application will be sent back with a rejection/blue sheet or your attorney/employer will get a wait-list letter. but all this not before 2nd week of june at the earliest.

                              Thanks a lot for answering the queries. Just one more clarification please:

                              So what you are saying is that USCIS is not going to send any rejections before 06/02. Not even the cases that were under Premium processing. Am i correct in my understanding here.
