  • GC Processing Time for EB2 & EB3

    Hi, I am new to this hence please forgive if i am asking repeated questions.

    I am applying me & my family GC through my employer. I have bach. deg + 9yrs experience and that too 6yrs with this same employer.

    Can i apply for EB2? or EB3? Which one is better and faster?

    How fast is the processing times for each of this category in current scenario. (lets say if i apply in a month's time from now).

    it is good to give following details to give you a better idea ...

    what kind of visa you have? how long you have been here in US? How many employers you worked for in US?

      Sorry forgot to provide this information..
      I am on H1 visa and completed 3yrs on this visa in USA. I have worked for 2 employers in USA but last 3yrs is with current company..

        EB category is based on what the real job requires and not what you have. If the job requires an MS or BS + 5 yrs experience, EB-2 may apply and EB-2 is generally faster than EB-3.

        Since you have 6 yrs experience in the same company and experience gained in the same company may not be used if the GC job is "substantially comparable" to the job you have experience in, you need to evaluate your options carefully. If the GC job is more than 50% different and the attorney has experience in such cases, you may be able to use the experience gained in the same company for a GC in the same company for EB-2 category.

        Prepare yourself before you talk with your employer and have a somewhat clear idea how the PERM works. Start here:

          Similar question

          I am having a dual bachelor degree(3 year degree) with 7 years of experience in relevant field. Am I eligible for EB2 green card process?

          But my attorney said they require 4 year bachelor degree or masters to qualify EB2.

          Kindly advise.
