  • I-130 Approved Now What?

    OK I'm not sure if we should be excited yet, or what exactly this means. My wife has been over in the US on her visa. We were married last year so we obviously wanted to apply for her green card. We sent in our I-130 and I-485 with all the supporting documents. Today I received an I-797 letter saying that our I-130 has been approved and to submit our I-485. This is confusing on two levels, firstly because we haven't have an interview yet, and most people say they get their I-130 approval after the interview. On top of that it's requesting we send in our I-485 when we already have months ago with the I-130. So now we're really confused what should we do should we pop open the champagne yet or no?

    Well it's definitely an approval letter but why they are asking fora the 485 is beyond me. As I know that goes with your 130 mmm I would make a call to USCIS and just check as this could just be a mistake in printing and not all AOS have an interview . Also give it a week and see if you get card in the mail. Not sure hopefully someone else has more ideas on this for you but congrats.

      i-130 Approved Now What?

      Dear Titus, 1-130 approval does not grant you any privilege it only means that the marriage on which the I-485 is based is recognized by USCIS as being genuine. Now you don't have to do anything, the wordings of the approval letter is standard and is not specific to your case, since you have filed an I -485. In most cases the I-130/I-485 is adjudicated together unless USCIS still want to conduct more investigation on the grounds of eligibility or interview is pending. The eligibility criteria for I-130 is different for I-485. So rest your soul and wait for your GC if you have no eligibity issues.
