  • Can H4 EAD holder start an LLC?

    Hello all,

I am on H4 EAD and want to start a business into real estate (house flipping) in Texas. Looking for answers to the following questions.
Am I eligible to start any business entity, LLC or corporation etc?
If yes, what kind of business entity should I consider to get more tax benefits?
How can my husband be involved into this company without violating his H1B rules and regulations?

Thank you for your help in advance.

Yes, you can engage in self-employment, but your husband can not. He can only participate passively as an investor

Your husband is not permitted to engage in self-employment, but you are free to do so. He is only able to take part in the process indirectly, as an investor.

As an H4 EAD holder, you can start a business in Texas, including forming an LLC or corporation. An LLC is often a good choice for real estate businesses, offering flexibility and tax benefits like pass-through taxation. For tax efficiency, you may also consider an LLC taxed as an S-Corp. Your husband, on an H1B visa, can invest in the business but cannot actively work for it unless he obtains a different visa or status that allows employment. It's important to consult with an immigration attorney to ensure compliance with visa regulations.
