  • Reinstatement or re entry

I am a student on F1 Visa enrolled in an university in CA for my MBA program, I wasn't happy with certain Practices at the University so I have registered myself for Full Time MBA program at an other university and requested the management to transfer my Sevis. However, the DSO and the Management has refused to transfer my sevis and informed that they terminated my Sevis and asked to apply for Reinstatement.
Please kindly help me on the following

Is reinstatement a better option or re entry.
My husband is on F2, If I go for a re entry do I need to take my husband along with me?
At the time of re entry Can my husband change his status to F1, Is it mandatory for him to go to India for his stamping or can he go to Canada, mexico or Bahamas etc.,

Kindly update me the possible solutions.

I was also going through the same question few days back. What I found was that both has its own risk. If you go reentry then based on your past record, they might or might not prevent you from reentering US at port of entry ( airport ) but if you go reinstatment then they might or might not reject it based on the explaination you have provided them of your case. Actually it depends on the reason for termination. If the reason for termination is simple like you mentioning or may be attendance, grade, tution fee etc then re-entry is a good option but if the reason is something very unlawful like Unauthorised Employment etc then you better apply for reinstatment and prove the genuineness of your case to Sevis throuugh any student-case-centric lawyer or yourself.
