change of status / expired?

Hi
This Odrisho. I applied for change of status from b-1/b-2 to f-1 by I-539. Its almost 48 days gone. Could any Expert tell me, when this decision will make, and 2nd question is during this decision making , can I stay legally in USA , if my stay permit expired?
Pls help me by give an answer.

Hi Odrisho,

By my calculation, you sent in your application in the first week of November 2013. To which service center did send it? Since that will determine the processing time. VSC takes about 3.3 months while CSC takes 2.5 months. I sent mine to VSC in the last week of October 2013 but yet to receive their decision.

While you have a pending application with immigration, you are required to stay in the country (and not abandon your application) even if your I-94 expires and you will not be violating the law until a decision is made.

It doesn't work that way. You can't select a Service Center or USCIS office to which your petition can be sent. The destination is determined by your location or by the form. For example, all K1 I-129F petitions are first submitted to a USCIS Dropbox address in Texas, then later routed to Vermont or California, based on workload and/or location of petitioner.

H4 ending and converting to F1

Hi,
currently I'm on H4 and pursuing masters in IT. I'm going to apply for change of status to F1. But my H4 visa is going to end by april. And I heard like updating status might take 3-4 months.
currently I'm on H4 and pursuing masters in IT. I'm going to apply for change of status to F1. But my H4 visa is going to end by april. And I heard like updating status might take 3-4 months. So after Getting F1, will they give F1 status date from the day MY H4 visa ends? I.e from april?
