Petition for children

When my husband petition me my children are included. I got a K1 visa and flew here in US without my kids. This was year 2012. I want to know if I have to really the petition for my kids or re-open my petition where they are included. Pls help thanks.

A K-2 can only follow to join within one year of the issuance of the K-1 visa, so it is too late for that. You or your husband can petition for your children. If you are a US citizen, then there is no difference between you petitioning your children and your husband petitioning them. If you are a US permanent resident, your husband petitioning them would be much faster as there is no wait for under-21 unmarried children of US citizens, whereas for under-21 unmarried children of permanent residents there is a 1.5 year wait.
