  • Currently on H-4 , doing MS , query regarding in-state tuition and H1

    Dear folks,

I am currently on H-4 (dependent visa). I am currently pursuing MS and will be completing in December 2012.
Since I am on H4 (but have not completed 12 months in texas) will be eligilble for in-state tuition from Spring 2012. I will continue my studies on H-4 until I complete my MS.
I am Hoping to apply for H-1(through a consultancy) in march 2012 and receive H1 by October 2012.
If my H-1 is pending will I still be eligible for in-state tution for the last 3 semesters as my current visa would still be H-4 ???
    Kindly HELP .

In-state rules vary by state and school, you should contact the corresponding officials at your school to inquire about it. They will be the best to tell you about it.
Once your H1 status becomes valid (from Oct 1, 2012 according to your plans), you must start working for your employer and get paid. However you can study side by side and change of status from H4 to H1 will not change anything about the tuition rate.
This is my opinion and not legal advice.

      Thankyou for the reply.

Another query is about F-1. If my F-1 is pending , am I legally allowed to work part-time ?

No. Even after F1 is approved you can only work on-campus for up to 20 hours a week. Off-campus work requires separate authorization. Your school's DSO will tell you about it.
