  • Help regarding H1 filing on OPT

    Hi,

    I am on OPT and it started on 1st Feb 2009. I joined some consultant so as to maintain 90 days rule. But that consultant never gave proper training and never did proper marketing , so I left him. Later I did not join any consultancy and started preparing on my own nd posted my resume everywhere. Now I have got full time job and my employer is ready to file H1 right now, since still some quota is left. My question is while filing for H1 will there be any problem because I had been unemployed in between for more than 90 days and haven't updated anything in my school since. In school I just gave information about that old consultancy that time and nothing later . Please suggest what to do. Should I go with H1 or should I apply for 17 month extension?

    You may be out of status if the everification for employment was not done every 90 days in the school. Your should ask your employer to file for H1b premium processing immediately and if it does get approved with an attached I-94, you may be fine. If the SEVIS system has you out of there, your H1b will be a CP case and you will need to get a visa stamp and re-enter.

    Talk to your ISO as the sevis system may have you flagged.
