On the UK border agency website, I read that an Indian citizen residing in the US and transiting through UK on his/her journey to India is exempt from requiring a DATV if he/she has:
"A valid airline ticket for travel through the UK as part of a journey from Australia, Canada, New Zealand or the United States of America to another country or territory, as long as you do not transit (pass through) the UK on a date more than six months after the date on which you last entered Australia, Canada, New Zealand or the United States of America with a valid visa for that country. "
This begs the question that does a person (Indian passport holder) with a valid (unexpired) H1B visa still need a DATV to transit through UK, if the person has not entered the US within the last 6 months?
On the same website, under the exemptions from DATV, is listed the following:
"A valid visa for entry to Australia, Canada, New Zealand or the United States of America and a valid airline ticket for travel through the UK as part of a journey from the country for which you have the visa to another country or territory. "
Applying this exemption clause to the valid H1B visa holder trying to transit through the Uk, I read it as 'not requiring a DATV'.
The two exemption items I listed seem confusing and somewhat contradictory.
