DATV / Transit visa to UK

Hi,

I had booked my flight from LAX - London - Blr through British Airways. My layover time in London is 3.5 hours and my connecting flight is within the same terminal in London Heathrow. Do i need to apply for transit visa?

Pl. find below are my visa status:
1. H1B visa expired on may 2008 and going to have my visa renewal in india.
2. got new I-94 issued till Dec 2010
3. got I-797A (which is approved)
4. my wait time is only 3 hours.
5. I have a valid indian passport

BA will not issue you a boarding pass without a visa. My friend had to cancel his trip and let go of the fare paid as well due to his stupidity.
