  • Be aware of Tier 1 Visa (Drawbacks & Risks)

For my Indian Friends, (and non Europeans)

I am writing this, because I spent almost 6months researching about Tier 1 Visa.

    Here are the facts

Two years ago, There was HSMP visa which allowed highly skilled people to go to UK without job offer. It was based on your qualification, salary and balance in your savings account. It worked pretty well since some of my friends went their.

Last year HSMP visa was replaced by Tier 1 visa General Category.

But it has major drawbacks. You need to score enough points to qualify for this visa

Generally speaking, if you are under 29 year age & last 12 months total earning is 8lac INR + you have balance of 2lac INR for last 90 days you will qualify for this visa. The visa will be valid for 2 years only.

At the end of 2 years, you have to apply for the extension, but again you have to score enough points to qualify for this visa.

Assuming now you got Tier 1 visa and you moved to UK and working in UK for next two years, then your age will be above 30 years, so you loose 10 points.

Then you have to earn totally 50000 GBP in UK within consecutive 12 month period in order to score enough points for extending your visa.

Even if your earned 49000 GBP you will not qualify for this visa.

This is the present situation. But before 6months, you need to earn only 36000 GBP to score enough points to extend your tier 1 visa.

By looking at these new rules, the British government's immigration policy is getting tougher and tougher day by day.

It is clear that, they don't want any non Europeans to stay in UK for more than 2years. Since if we extend our visa after two years we may get extension for next three years. Then we shall apply for permanent residence & then Citizenship in UK. It seems they have more than enough citizens.

It is clear that they want to make the rules harder, so that highly skilled foreigners come to UK and work very hard to earn more to stay in UK. If they earn more, they stay, otherwise they have to go home. It is very simple.

My kind advise, if you are an Indian or a non European, and earning good money in your own country, then it is a huge risk to take this tier 1 visa and land in trouble. If you are absolutely sure that you can earn more than 60K GBP then you can take this risk. Otherwise, in my opinion its not worth taking this risk.

But if your are trying for Tier 2 visa (means you need an offer from UK and sponsorship from UK) then there is fair good chance of extending your visa in UK. Qualification criteria for visa extension is easier than Tier 1 category.

Please let me know if you need any information.

    Thanks
    Vijay
