Green card lottery - born in India but Singapore citizen = eligible?

  • Green card lottery - born in India but Singapore citizen = eligible?

    I was born in India but I have lived in Singapore since I was 6 years old and am a Singapore citizen. I want to apply for the green card lottery but the eligibility test was based on the country of birth. India does not qualify but Singapore does. So am I still eligible to participate in the lottery? Thanks for the help!

    They go by country of birth and not citizenship.

      Where were your parents born? Here are the exception rules to the general chargeability rule:


      While visa availability is normally determined by the alien’s country of birth (in addition to the preference category), under certain circumstances, when a visa number is not available in the particular preference category for the alien’s country of birth he or she may utilize a preference number for a country other than his or her country of birth. Section 202(b) of the Act sets forth the rules under which an alien may be charged to a country other than the one of his or her birth. These alternate charg eability rules are designed to ensure that children are not separated from parents, that spouses are not separated from each other, that aliens born in (but not now citizens of) the United States are not precluded from receiving preference visas, and that aliens born during the temporary visit of their parents to a country in which they have no residence are not adversely affected by “an accident of birth.”

          I was born in an East-European country, the same as my father. My mother was born in a West-European country. When I was 6 months, my parents moved to that West-European country and I hold that citizenship. My country of chargeability was determined as the West-European country*. Moral of the story: not all parents are equal

          * Probably because USCIS was lazy: the East-European country no longer exists and during the fingerprinting process they couldn't figure out what state to use as it didn't show up in their systems..
