  • Asylum procedure from Detention through to Mariage and work Permit

    Good Evening,

I see on various forums and throughout this forum a great deal of information, but it is scattered. I was hoping to brief my situation and then be provided a "list" of steps to take in the proper order as opposed to asking about a specific step. This would give us a proper "Plan of Action". I understand we have the I-485,I-130,I-765, I-131, I-140, I-9876543433456345634... but if I could have it in the proper order. Comments posted next to stages and what I do know.

Brief: I am from a Western Country. Arrived USA 2009. Visa complications occurred 2010. Claimed Asylum 2010. Have not had Master Hearing as yet, various delays have occurred and rescheduling etc. My fiancee who I have been with since 2009 is a full American Citizen (Born and Bred). I am located in West Virginia and because of this, there is pretty much no immigration help locally, the staff of the free immigration clinics are shocked to find someone with an immigration issue who does not live in New Jersey it seems....We finally decided to confirm everything and marry in June this year (3 weeks away, actually!) Next scheduled hearing (to finally do the "Master Hearing") is in July 2013. My understanding is that I will need to file various forms post-marriage. I am about to request a continuance to the Immigration Court to allow us some time to have the marriage go through, and file the I-130 form which I fairly well understand and never have the Master Hearing actually happen. However, after this there is an I-485 form...and what else? I just want a step by step guide so that I can complete all the steps to get legitimate in the eyes of the Federal government, obtain a social security number, be totally legal, go back to University, work and rack up a nice mortgage debt (LOL).

    Steps:

    1. File a Continuance Request (which may or may not be granted, I will ask for 90 days).
    2. Get married late June.
    3. File an I-130 form. (is a petition my my to-be spouse to sponsor me),
    4. File an I-485...should there be any other forms filed after this? I read somewhere the I-485 must be given to the Judge(?)
    5...
    6...
    7...
    8...

I have read various books on immigration but these tend to deal with great overviews of the entire system and do not provide a precise guide for my situation, and it is my thinking there is person reading this who could bullet-point the required steps and actions. I am fairly open about giving any details needed to give me accurate advice.
