I am currently an exhange visitor holdiing a J1 visa. Both my passport and my DS 2019 say "not subject to 212e", however, I asked for an advisory opinion from the DOS and they determined that, in fact, I AM subject to 212e. I will request a 212e waiver on the non objection basis right now. I have NOT returned any documents to Kentucky as of today.
My questions:
- is there ANYBODY on this board who had a similar case?
- should I wait until I have the waiver or should I send DP122 and DS230 to Kentucky? It is my udnerstanding, that I only need the waiver when my number is current (EU227XX). I am getting nervous.
- is it advisable to do CP or AOS? As I said, I am currently on a J1 that is valid till 12/2014
- Finally: if I opt for CP i will have to fill out the DS230. Question 40j: Are you a former exchange visitor... I am a current exchange visitor, not a former. Should I say YES or NO? Or should I forget about CP and do AOS, where I don't have to fill out DS230?
