  • DV Lottery - AOS During the L1B Visa Renewal

    Hi
I really appreciate any advices comments or would like to hear if anyone have any similar experience.

    my current situation.
Now I’m L1B visa. I have been here for last 3 years. My Current L1 Visa +I94 getting expire on 12th May 2014. I have already submitted a renewal request through my employer. My company’s attorney submitted the renewal to USICS.
Meantime, Last week I found out that I have been randomly selected Diversity Immigrant Visa (Green Card lottery) for 2015. It says “Selection does not guarantee that you will receive a visa”. I went through the additional detail; I found out that, I meet the criteria they looking for. I’m holding bachelor’s degree, my profession is there, I have experience in US for more than 3 years. I meet everything.
    Question 1 >
I notice that there is an option called “Adjustment of Status” for the people who are already located in USA. I went through the details, they are asking for a valid visa to proceed in that path. Can I count that still I hold a valid visa? Can I go through this path?
They (DOS) are saying, DS-260 Immigrant Visa and Alien Registration Application form is getting available only on May 19th (After my visa expiration date)
The reason I want to get this path is that I read some comments online, if you go in normal path you may even not call for an interview. You may not even get the visa. Is that possible?
    Question 2 >
Let say I’ll go through regular process for Green Card. What if my L1 get approved meantime? How will that impact to my Green Card eligibility? Will DOS take that as a disqualification been in USA and not going through the “Adjustment of Status” path?

since you say that your company has a immigration lawyer you should ask him/her all those questions. if L1 is eligible under adjustment of status then you should wait when your number becomes available to file the proper document. you can go on google and type visa bulletin. every month the state department publishes the bulletin with the cut off for the following month you go and see in previous years when your number was called and have an idea to when you can expect to file for you green card. if you stay in the US you will have to go through the adjustment of status path but when you number become available u can decide to do the consular interview and go home to file for your green card. getting a legal advise is a plus i think
