  • Minor adaption in Philippines

    My mother ( A U.S. Citizen )adopted a minor in the Philippines. She's been taking care of her for the last seven years. My concern is that my mother is 70 years old and if something happen to my mother ( like if she died) , what will happen to the child? Can I petition the child because she is my minor sister (technically)? What will be the best option?

    Please can anyone help me!

    Dear sister,

    first of all,Your Mom doesn't have to adopt that child because technically,she's her daughter(you said so yourself,she's your sister).Secondly,Your Mom can petition her as an unmarried child.You can petition her also as a backup as your sister which will take roughly 10-20yrs wait.The best thing is consult a reputable attorney as to which avenue is the fastest.

      revise explanation...

      I misunderstood it...again..If your mom adopted someone in the phils...it just takes 2 years for her to stay with the child...as what the law states..then she can take the child to the U.S.
