Work permit in political asylum help!!

hi there, i had the interview on april 17 this year, they didn't grant me the asylum,so in the papers they gave me i have noticed that by what says there: i can apply for a work permit not sooner then 90 days after i had my interview...wich is july 19.
my attorney called me and said that i can not apply for a work permit now, because i have to submit some additional papers, and they will start the 90 days countdown only after i submit those aditional papers...is this some attorney mistake,or is this legally possible.
