I’d like to find out if my sister has a chance to get her green card and be freed from the removal process. Here's her story: in 1994 she applied for Asylum, which she didn’t win. The judge instructed her to leave the country in 1997 and the case was closed but she didn’t. Meanwhile, in 1997 she had daughter who's now going to school and she got married to a US citizen 2 years ago. After that marriage, the husband petition for her, the application for the green card and the work permit were sent to USCIS. After processing her application, she was arrested in Nov 2009 by ICE stating that she needed to be deported but then released on $20000 bond. After she was released in Dec 2009, she went to the interview with the husband, which they passed and was successful. As result, she was granted the work permit.
While, we were waiting to hear from USCIS about the status of her green card application and to see if the asylum case would be override by the petition by her husband, ICE sent a letter, just 2 days ago stating that the husband needs to appear with my sister regarding the bond and her case.
Our concerns are:
1) Are they (ICE) trying to arrest her again for deportation and give them the bond money of $20000 back?
2) Anyone familiar with ICE removal process after the alleged applicant posts a bond?
3) Is this possible that they settle the case with the bond money and let her go even she was asked to leave by the judge?
4) Do they really want the money or they really want her to leave the country even though she's settled now with a US citizen and leaving a happy life?
