  • F-1 to GC DV2011 (I-485/I-765 pending) ..can I accept work?

    Hello everybody,

My question is: Can I accept and begin a new employment while my I-485/I-765 (DV visa lottery) Adjustment is pending, given the following background info? Thanks so much for your thoughts.

    1) I have just been offered a new full-time employment that is set to begin January 3, 2011!
    2) I have a valid EAD card, based on F-1 visa post-completion OPT, which is valid 01/06/2010 - 01/05/2011.
    3) I am a 2011 diversity visa lottery selectee, found eligible to adjust status.
    4) I filed I-485 along with I-765 on October 1, 2010 when my visa number became current (I am EU citizen with visa number 3000)
    5) Completed Biometrics November 22, 2010
    6) Have not received a new EAD card

I don't see any reason why you cannot accept the employment. I was almost in the same situation - I was employed on F1 CPT, filed to AOS and already got it approved. I didn't get EAD though I filed for it as well. I think they don't issue EAD since DV cases take 3-4 months to adjust.
