Can I travel in B1, when my companty is applying for L1?

  • Can I travel in B1, when my companty is applying for L1?

    My parent company in US is going to file L1 premium in near future.
    Now I am in a position to visit my parent company for business using a valid B1 Visa.

    I have some doubts about the L1 filing and getting approved when I am in US.

    1. If I travel to US via B1, can my company file L1. How will that affect the change of L1 when I am there?
    2. Or if I can delay my travel after the L1 was filed, will there be any effect on the L1 processing or issue during my port of entry with B1?
    3. Will there be any issue when I am traveling back after my business when my L1 is under processing?
    4. During my stay in B1 (scheduled for 2 months), if my company applied for L1 premium and I get it approved, will that affect my travel back to india and getting L1 stamped?

    Please advise.

    First of all 2 Months on a B1 trip can be considered too much, it might be questioned not only during the B1 trip but may eventually come up in the L1 interview too and might lead the VO to think that you were actually doing work rather than meetings during your B1 trip.


    Though your B1 travel and L1 application are independent, its prudent to keep B1 visit to only a few weeks, and apply for L1 after few months of returning from a B1 visit. Some Organizations immigration team prefer it that way as then it doesn't give semblance that you went to do work on B1 as L1 was still under process.
