    I went for visa interview in the 1st week on Jan 2013 at chennai and got pink slip. Passport retained and they asked details of siblings, previous work experience etc. I was reading forums (this one and others) and I see lot of people are saying they got visa after 3 months also and I one person said more than a year later. Through a colleague I came to know of another person who got it after 4 months in the same company. His case and some others say passport returned, some say passport retained. My question is will they retain my passport for that long if needed, i.e 3-4 months or so? If yes, does US Embassy has the right to hold our passport for that long? What if I get an urgent need to travel elsewhere?

    80+ views and no responses? One more week is gone, I am not happy that they are keeping passport so long, does anybody have any information about the right to hold passport, if they are going to take their own sweet time to give visa?

      No one can tell you about the 221g admin. processing time . Each case is different. It will happen when it happens.

      About passport; there are some posts who requested their passport back at the time of interview when they were given the 221g slip.
      When they got the call about completed processing, they sent their passports.
      You should not worry about them holding your passport.
      If you need to travel, you can contact VFS and have it back.

        I understand it may take time. At that time I did not know how to react so I gave it. I also understand they will give it back if I ask. I also understand my passport is probably safe with them. But I am questioning the moral authority of a non-Indian entity to hold my passport for that long without having to provide any justification of holding it. I am sure a hue and cry will be created in the states if the Indian embassy holds passport even for a few days. But here we are expected to sit quiet and wait for months with no information for even 3-4 months.

          Almost one month since my passport is with them. Anybody has any legal information as to how long an foreign entity can hold passport without any justifiable cause in India?

            No updates. Going to be a month. But I am mentally prepared for it to take long time and after a certain time has crossed, I am going to ask them to return the passport. I am just not able to believe their complacency in dealing with people from other countries. I really would like to ask them how their country would react if Indian Embassy starts to retain US passports in US when they apply for visa or for some other reason, there will be a huge cry on privacy and policy and what not.

              Finally got the visa and more importantly the passport. Wishing others luck and hoping they improve their processes which are unnecessarily causing losses and delays to people.

                221g white slip for B1 in New Delhi

                Hi, I applied for a B1 visa. I am a student and I was supposed to be presenting a paper at a university in US. The funding papers were in place. My interview was fine, after which they handed me the white 221g slip. I am not supposed to submit any docs but they told me that I would have to wait for atleast 3-4 weeks before the processing is completed. Obviously, I will have to cancel my trip but is there a chance they will reject my visa application? They took my passport.
                Any clues, anyone?

                    The next caller asked about provisional waivers. He wants to know how USCIS and DOS are working together/how the rules about interviews were made. The second part of the question is about when LPR can be considered qualifying relatives for the I-601A waiver. The third part is venting about how long some consulates take and operate (mentioned New Delhi, Lima, and Yemen as offenders). Mayorkas said he couldn't really comment why the consulates operate how they do. He also said that USCIS had to draw the line somewhere mohajerat about who is eligible for provisional waivers. The caller wanted to know how DOS and USCIS can work better together to make things faster. Mayorkas said it would be a good idea to have an engagement with DOS, DOL, and sister DHS agencies.

                        Admin processing - Passport help

                        It's been around 23 days now and we are still waiting for Admin processing result. Can we send a reminder email on the top of previous email as Conference is starting on April 1.

                        Please suggest the best practise for this. Please suggest any way out to send a gentle reminder.
