My passport has been requested but I havent been able to send it out..(urgent advise)

Good Morning good people of this forum, I recently applied for a business visa to the U.S from Nigeria in Nov 2012 and was placed under admin processing. However, the consular didn't take my passport he gave it back to me.
On Jan 11th, I got a call from them saying the visa has been issued that I could come submit my passport from Monday - Thursday for it to be stamped on my passport , I was meant to travel on January 18th for this conference but because I applied for a business visa at the Hungarian embassy and they have my passport since last yr December , so I have not been able to submit my passport for my visa to be issued please I'd like to know if this is a problem or I can send in my passport anytime?
Do you think the Embassy will still put the visa on my passport after they have asked me to come get it since Jan12th?
I have emailed the Hungarian Embassy in Kenya because they have no Embassy in Nigeria, my passport was taken there they have not replied and wont pick up their calls, I am very bitter about this, can I take a legal action on the Hungarian Embassy for with holding my passport for this long despite the fact I have tried to reach them but no success. Please advise.

Admin Processing again

Well 71 views and no one can comment? I thought this was a help forum?? Well update is .....................

The Hungarian embassy with held my passport from 19th of Dec and finally sent it back to me on the 8th of Feb after battling with them. Then I submitted my passport to the U.S consulate on the 11th of Feb 2013 for the stamping this is after one month of them requesting my passport for stamping (Jan 11th 2013 I was called and I submitted on the 11th of Feb 2013) and was asked to come and get it on the 14th of Feb 2013 but I went and it wasn't ready I tried to track it on the [email protected] but it says "there is no update for the passport number submitted". So with the help of this site I found out I could check it on

https://ceac.state.gov/CEACStatTracker/Status . Which I did only yesterday 19th of Feb 2013 and found out it was on Admin processing again. I am wondering why it has gone back to Admin Processing again, when the told me it was approved and I should send in my passport.

Can someone please advice.
Or is everyone viewing this query seeking help?
