    Hi,

    I have been in US from 2003 to 2012.. my green card processing is going on. My labor is approved long time back and is waiting in the long EB3 queue.. Last year september I moved to Sydney Australia. I would like to travel to US to attend a business conference. What are my chances of getting the B1 approved? Is applying for B1/B2 better than B1? Also is there any potential negative consequences in getting the B1 rejected for my ambition to return to US in the future?

    A B1/B2 denial does not affect other visa applications, unless you are caught lying or misrepresenting.

    B1/B2 ( does not matter B1,, B2 or both) is usually difficult to get with a pending immigrant petition because
    B1/B2 requires a non-immigrant intent. That said, one can still get it if there is an emergent situation or the officer
    is convinced that your current trip will be temporary.

    In your situation, your history of stay in US will be of paramount importance.

    *You stayed there so long, on what visa status?
    * were you ever out of status? for how long?
    * How much more to go in the EB3 queue?
