  • Need suggestion - going for B1 visa and had F1 before

Hi, let me explain you my case first....

I entered in USA on F1 visa for MBA in 2006. Successfully completed my MBA in 2008 . I worked one year on OPT and then enrolled in MS Software Engineering in 2009. Went back to India and got new stamp for F1 for new university till 2014. Here I completed 2 semesters. Then I was visiting India to get married in 2010. I and my wife went for her dependent visa (F2) but the visa officer denied her visa and cancel mine too under 214. Since then I am working in India for same employer for more then 3 years now. This employer (multinational) filed H1 and got approved and will go for stamping in September. I am working on a product from more then 1 year and need to visit USA to attend couple of meetings next month. So I am going for B1 stamping early next week.

My question is should I go for B1?? If yes then if they deny my B1 then is it going to be a -ve impact on my coming H1 stamping?? It is kind of mandatory to attend this meeting as its directly related to my product launch and success. I am confuse your help is appreciated......

    URGENT reply will be helpful

No. B1 denial does not affect H1b, (unless you lie about something ).

By the way, I am very curious your F1 was canceled midway through your studies. Why? It is really surprising when the same people issued you the F1.

Since you were going for another Masters degree after completing one, they were not satisfied that you did not intend to immigrate.

Unfortunately, the F1 denial will affect your chances of getting a B1 Visa. But, it will not affect H1B since H1B allows immigrant intent.
This is my opinion and not legal advice.

Thank you Kab and Peace.........so i guess i should go for B1 because it seems like it is not going to affect my H1B any how.
