Hi Everyone,
I had applied for my B1 VISA from my company before 5 months in mid of April at Chennai, India consulate. Consular asked me all normal questions and then said "Everything else is fine with your application but we need to do some processing before we can grant you a VISA" and gave me a pink Slip, and asked me to wait till the time my number is call again. Immediately my number was flashing to go to another window where an Indian lady was sitting. Again, she asked me few questions like where is my parents, my sister etc etc and then asked to give me my client invitation letter and ask me to hand over the passport. I gave her the passport and she wrote a tracking number on my Pink Slip given by the consular. She asked me to track my application with that 14 digit number. That day and today's day there is neither an update on my application nor on my passport. Its been more than 5 months now.
I have constantly tracked my application with the number given, but it keeps saying "Administrative Processing". I did write an email after completing approx 4 months to the consulate as they had said not to contact them before 3 months of an application! But without any significant response. I think it was their standard response:
"Dear Applicant,
Your application is still pending under Section 221(g) of the Immigration and Nationality Act (INA) for mandatory administrative processing. There is no definite time frame for this processing as it depends on the individual circumstances of each case. The Department of State is continuously working to improve processing and expedite visas, and we appreciate your patience. Please be assured that we will contact you as soon as processing is complete.
Check the status of your visa online with the U.S. Department of State’s CEAC Status Check -
Use your CEAC barcode or case number and the location where your interview occurred to check the status of your case.
Click on “Check My Visa Application Status.” If you received a 221g letter or were told your case requires further “Administrative Processing” this system will let you know if your case has been approved, requires more information, or is still being processed."
The case reason is mentioned as "Hold case/221 G & Refusals/214B" in the response.
I again responded them to confirm that they have my Passport! But again, they sent the standard response. I was tired and worreid about my passport and thought of posting for any help here. I am worried if my passport is lost by them? And when will I get it with the VISA Application status? Just wondering who to approach for the help.
And yeah I also checked the status in the PDF they have here:
It too says the same status.
Shall I go and approach the Consulate directly? Will there be any problems for my future US Visa application if any? What should I do? Is it legal to hold any body's passport for 5 months?
