  • Re-applying for B1 and worried

I am a business owner and import products from USA which has a turnover of about USD 200k.I had applied for b1 in Feb 2013 and was rejected then stating I don't have enough ties with my American supplier and now as the situation has changed i am applying again as i have been importing lot more and also have received invitation letters from two of my supplier saying that they will be responsible financially and morally when i am in States and how important this meeting is and that i would return to my friends family and business etc after visit, which of course i will.I am also participating in one of my suppliers conference and have enrolled for the same and have made the payment which is not refundable as there was no other way as seats were limited

The thing that is worrying me is that last time when the agent filled ds-160 for me i had provided him info over the phone and most of the info i remember what i provided but the info regarding my last 5 years employment dates were provided in ball park idea and same with my Educational qualification dates. He did not save the information that he had filled then, so that i can retrieve that now.I am filling ds-160 again myself this time with exact dates.Would this be a problem? Will the consular or the embassy cross check the whole details of last filled ds-160 and this one or this ds-160 replaces the last one? Or do they only focus and cross check the info regarding my ties with my American supplier as that was the reason for rejection? Or they would not bother to ask about the same as its not relevant as i am going for business meetings.

I am filling ds-160 now and would like welcome any suggestions for successful interview with the above issues that is worrying me.Please, share your experience if someone has been through this kind of situation and what can i expect.

    Dipistu,

I am entirely sympathetic and optimistic about your stated current evidence improvement and prospects for approval of the new visa application.

Are you sure that you cannot retrieve a copy of the DS-160 that was completed before? Normally, at least with the DS-260 (immigrant application), one can return to the website to the DS-260 that was saved there browse through it. I don't know if there is a "cutoff" for availability of either form, but you should explore whether you can get back to the original form.

While I don't believe any "minor" deviation from dates originally provided (on the first DS-160) would be much to worry about (minor discrepancies and inconsistencies are common between forms for the same applicant), there is the "bureaucratic" factor to consider. While reviewers haven't the time or resources to closely review all history, your next interviewer will see a prior denial which gives him reason to question why this application should be handled any differently than before, followed by his comparison of similar information from both applications.

What should happen "next" in any such analysis is to question whether data differences are simple human error of no great consequence, or if there is any indication of "made up" data or withholding of information to gain an immigration benefit.

Thanks for the reply Ray B

I did try to retrieve the ds-160 that was filled on Feb infact i even emailed the embassy saying :-

      Hi,

I had appeared for interview for B1 visa on --th Feb 2013 and my visa was not approved stating 214b where i was told that i don't have enough tie with my US suppliers.

I wish to appear for interview again now as my situation has significantly changed.I would request you to send me my Application ID as i did not save that ID then.I want to use the same application as the digital photo of mine was accepted in that application.I want to upload the same application and generate new barcode and confirmation ID.

      the reply i got was:-

"You will need to re-enter the information as we cannot retrieve your Ds160. You will have to print it and pay at HDFC Bank"

Moving forward now, i just hope it wont create a problem and things would go smoothly.I was told by someone that if there is discrepancy in information the consular can create problems in future applications also and can get barred from visiting US forever.I have a proof that the current details provided are exact as i have checked the certificates while filling the form and though i have logical explanation that someone else filled my form last time, it would be unacceptable as it says in their website that whoever fills the form the applicant has to click the submit button and that serves as a digital signature.

        Dipistu,

The "someone" who told you "...that if there is discrepancy in information the consular can create problems in future applications also and can get barred from visiting US forever..." is not being realistic. Almost any two similar documents completed at different points in time will be found to have minor differences in same data, and gvoernment agencies have an understanding of this reality when dealing with case files and forms. The real issue is whether information provided (or not provided) is indicative of "hiding" or "withholding" pertinent info used to make a visa-related decision, or whether conflicting information results in a government benefit which might otherwise be denied.

It is true that information discrepancies can raise questions, but "minor discrepancies' do not result in "barred from visiting U.S. forever." Attempted visa fraud, lying to a Federal officer, or admitted use of illegal drugs can result in a lifetime bar from entering the U.S. (but not always). Date inconsistencies of employment or education, on the other hand, are quite common and rarely result in serious adjudication problems.
