    Hi Experts .. Greetings..

    I have a query , hopefully i get answered. I am in US on a B1 Visa as i came for new project demo to clients and luckily we have been awarded the Project in IT. So my company wants me to move from India to US entity and process L1B for me. My B1 visa is expiring on Jan 3rd ( I -94 ). My HR says that if they file a Petition and get a reciept number , i need not worry .I can stay in US Till i get my L1 approval.

    1. Is this fine, can i stay in US even after my I-94 Expires? if so how long.
    2. If my L1B petition gets rejected, will that pose any challenge for my next entry to US?
    3.Any other things that i need to be aware of or any precautions?

    With Jan 3 not too far, it is a given that the response will come after that date. Yes, you will be legal till the response comes.
    If it is a denial, technically you will become out of status instantly. You will have to leave asap and on next entry you will have to prove
    that you left immediately after receiving the denial.

    A history of change of status ( successful or not) is a negative when applying for a new B1/B2 when this one expires.

    An L1b stamp is always better than a change of status as one can travel and reenter freely out of US if one has to.
    With a changed status, if you leave US , you will have to get a visa stamp abroad to re-enter.
