  • Urgent clarification needed on B1

    Hi,
    I am in a critical situation and need your advice to proceed further.
    I am now working for X company, company Y approached me and they offered a job in US and started Processing H1B for me.
    My H1B petition is selected in lottery and waiting for receipt number. Now my company X is pushing me for a conference in US through B1 visa.

    Can I apply for B1 if my H1 is in process ?
    Will there be any impact in my H1B ?
    Is there chances that both visas get rejected ?

    Please help me with this clarification, I am really confused because I cannot say my current company X that I am processing H1, it might lead to termination. Your timely help is much appreciated.

    There is no conflict. H1b petition is under process in US and you are not yet employed by that company.
    While B1 is for the current employer and you do not need to declare anything about the future employment when applying for the B1 visa.

      Hi, thanks for your reply. But some says that while going for B1 interview there are chances that they would ask for only one Visa approval. is that true ?

        I do not follow you what you mean by your statement.


        Once you go for a B1, you won't be requesting an H1b because that petition is still not approved.
        After you get your B1 and visit US, you get an H1b approval and you leave the first company and apply for an H1b for the second company. There is nothing wrong with this.

        Your previous B1 will stay and you will also get the H1b.
